§ 1 General Information and Business Relations

These General Terms and Conditions apply to all contracts concluded via the online shop kardelen.de between the seller Menceloglu, Bahnhofstraße 93, 45701 Herten (hereinafter referred to as "Seller") and its customers (hereinafter referred to as "Buyer"). Contracts can be concluded with both consumers and businesses. A consumer is any natural person who enters into a legal transaction for purposes that are predominantly neither commercial nor related to their independent professional activity. A business, as defined in § 14 of the German Civil Code (BGB), is a natural or legal person or a partnership with legal capacity that, when entering into a legal transaction, is acting in the course of its commercial or independent professional activity.

§ 2 Formation of the contract

The products and services offered in the online shop do not constitute binding offers, but rather an invitation to the buyer to submit an offer. By submitting the order, the buyer makes a binding offer. The contract is concluded upon the seller's immediate acceptance via email.

§ 3 Prices, Sales Tax, Payment

All prices are final prices including VAT, plus shipping and handling. Payment methods are bank transfer (prepayment) and PayPal. For prepayment, the invoice amount must be transferred to the specified account no later than seven days after ordering. In case of late payment, there is no entitlement to delivery, but the obligation to pay remains. If the item is unavailable, a voucher will be issued. After 14 days of late payment, a reminder will be sent with a €10 late fee; thereafter, a debt collection agency will be engaged.

§ 4 Delivery, shipping costs, transfer of risk

Delivery will be made after receipt of payment or PayPal confirmation. Delivery terms and dates are specified in the order form and product descriptions. For consumers, the seller bears the shipping risk; for businesses, the risk passes to the buyer upon handover to the shipping provider.

§ 5 Cancellation Policy

Consumers have the right to withdraw from this contract within 14 days without giving any reason, with the exception of personalized items such as name-branded items or earrings, vouchers, individual set components, and gift boxes. To exercise this right of withdrawal, a clear statement must be sent to Kardelen, Bahnhofstraße 10, 45701 Herten, by letter, fax, or email. Return shipping costs are borne by the buyer, and compensation for diminished value of the goods only applies if it exceeds what is necessary to inspect the goods. The right of withdrawal expires for custom-made or sealed goods if the seal has been broken. A cancellation fee of 5% of the product price applies to withdrawals.

§ 6 Retention of Title

The goods remain the property of the seller until full payment has been received.

§ 7 Liability for Defects

The statutory warranty rights apply.

§ 8 Conclusion of contract and technical information

The ordering process is completed via the shopping cart and the "SUBMIT ORDER" button, which constitutes a legally binding offer. Input errors can be corrected until the order is submitted. The contract text is saved and sent to the customer by email after the order is placed. The contract language is German.

Section 9 Data Protection Notice

Personal data is processed in accordance with applicable data protection regulations and only shared with service partners, such as payment institutions and logistics companies. Customers can object to the use of their data and have the right to access their data.

§ 10 Alternative Dispute Resolution

The EU Commission provides an online dispute resolution platform, accessible at http://ec.europa.eu/consumers/odr/ . There is no obligation or willingness to participate in consumer arbitration proceedings.

Section 11 Battery Ordinance

Please note the legal requirements for returning and disposing of batteries. Batteries must not be disposed of in household waste and are marked with a crossed-out wheeled bin symbol.

Section 12 of the Electrical Equipment Act

Manufacturers are obligated to take back and label old electrical appliances. Retailers inform customers that such appliances must be collected and disposed of separately.

§ 13 Applicable Law

German law applies; consumers abroad can also assert their right of residence.

§ 14 Deviations for personalized products

Personalized products may differ from the image in the shop, e.g. in size, style or gilding.

§ 15 No right of withdrawal for customized products

There is no right of withdrawal for non-prefabricated, custom-made, and sealed products once the seal has been broken. Engraved and personalized products are also excluded from exchange.

§ 16 Assignment of Claims

Claims may be assigned to SAHU MEDIA Technik UG & Co. KG, Berlin, for enforcement. Personal data will only be shared for this purpose.
